The European Union has appealed the WTO panel report in the case concerning EU countervailing duties on Indonesian biodiesel imports (DS618). The decision was announced during a WTO Dispute Settlement Body meeting in Geneva, following the report’s circulation to members on August 22, 2025.
Indonesia expressed regret over the appeal, noting that the WTO Appellate Body remains non-functional due to blocked appointments, making it impossible to process new appeals. The EU recalled that it had invited Indonesia to join the Multi-Party Interim Appeal Arbitration Arrangement (MPIA), a temporary mechanism designed to safeguard appeal rights during the Appellate Body’s paralysis.
As WTO members have yet to agree on filling vacancies in the Appellate Body, the EU’s appeal cannot move forward for now, leaving the biodiesel trade dispute unresolved. Further details will be published in official document WT/DS618/5.
